THE LEGAL PURCHASE PROCESS
The following information is intended to help you understand the legal process of buying a property in Turkey and to give you a mention of the obligations of a Turkish property ownership.
1- When you have decided on the property you would like to purchase; we will take you to the solicitor’s office where the sale agreement will be drawn up. The solicitor will ensure that the title deed of the property is checked, that the seller legally owns the property, whether there are any charges on the property, where applicable that building licences and permissions are in order, and that the terms and conditions stipulated by the seller are fair and just. The sale agreement will be translated by the legal translator as the contract is in Turkish, and the legal translator will also provide a typed translation . The solicitor, legal translator, buyer and seller will sign the sale agreement, and each party will be given a copy of the sale agreement both in English and Turkish. And we will also recieve one for our records.
At this stage the initial deposit sum of £ 2.590 / € 3.885 / $ 5.310 need to be paid. This initial deposit covers the deposit to the seller ( builder ), solicitor’s fees, legal translator’s fees, mapping charges, and notary costs. It’s adviced to take this money in the form of cash where possible.
2- If you think that you will be unable to be here at short notice when the deed’s check is complete, you will also need to set up a Power of Attorney at this stage. Power of Attorney will permit the authorized person the legal allowance to sign for the transfer of deeds from the seller’s name into your name, on your behalf and in your absance.
If you would like to give the solicitor in Turkey Power of Attorney to sign for the release of your title deeds from the title deeds office once the deed’s check is complete and they have been authorized, we will take you to the Notary Office to have this done ( possible only during week days ). Please note that giving the solicitor Power of Attorney does not give us or the solicitor any claim over your property, the title deeds will be in your name and will be including your photograph. After this you may leave Turkey, and send the money from your country ( amounts and dates as per contract ).
3- The solicitor will than arrange for the paperwork to be prepared for the transfer of title deed into your name and for military check on the seller receiving the next payment. Maps are collected from the local council that precisely locate the property, and these, along with the relevant ID ( passport and passport photos ), and a copy of the title deeds are handed into the relevant Title Deeds Office. The application is processed, given a reference number and is then sent off from there to the Aegean Army Base in Izmir for the military check. This military check is only to determine that the area the property is in, is not within a certain kilometer radius of a Turkish military zone. This military check process may take from 2 weeks to 6 months. Please note that once the application leaves the Title Deeds Office, neither them nor us are then able to give updates on where the application is in the system.
4- Clearance is granted when the application returns to Title Deeds Office and we will inform you at this stage. At this time you will have to pay the balance due for your property, the buyers tax, earthquake insurance, and the water and electricity connection fee. We will inform you of all payments that need to be maid at this stage (as reflected on your payment plan in sale agreement )
After this process, you are the owner of a Turkish property. Enjoy your new life owning a place in the sun, meaning that you started to live the dream .
